Waiver and Limitation of Liability
Read Carefully. This is a waiver of certain legal rights. By permitting Hassle
Free Cell Phone Repair LLC, hereafter referred to as HFCPR, to diagnose and/or repair
said equipment you agree to be bound by the following:
By signing this, customer
understands and agrees that HFCPR is not responsible or liable for damage to equipment
during full timeframe of possession of said equipment. Customer understands that
they are leaving their equipment at their own risk and as a condition precedent to
choosing HFCPR agrees to fully and completely release, indemnify, defend, and hold
harmless HFCPR from any and all claims arising from the services provided by HFCPR. This
includes damage to equipment caused during examination as well as damage to equipment
in which products are installed.
Unless specifically set forth herein, HFCPR
makes no representation or warranty, express or implied, with respect to any services
sold, and HFCPR specifically disclaims any liability for direct, indirect, consequential,
punitive, or special damages, including without limitation damages for lost data,
lost revenue, lost profits, lost storage cards, lost SIM cards, lost cases and other
accessories, cost of replacement parts and any and all costs arising out of the services
rendered under any theory of liability, even if the damages complained of arise from
HFCPR’s negligence.
Customer agrees to permit HFCPR to diagnose and repair my
equipment. Customer agrees to the minimum labor charge of $20 plus shipping and
is bound by agreement to pay this if customer decides not to repair said equipment.
Refusal of said fees gives full rights of possession and ownership of said equipment
to HFCPR. It is also understood that the date of completion is only an estimate
and can change for reasons out of control of HFCPR.
There will be absolutely
no refunds, only repair of said equipment after inspection for damages not caused
by HFCPR. Only at the discretion of HFCPR can or will this be changed.
Full
payment is due upon completion and notice to customer. Failure to pay within 10
days of completion and notice to customer gives full possession and ownership of
said equipment to HFCPR.
